What is the subject of the Privacy Policy?
This Privacy Policy defines the rules for processing personal data obtained through the website at www.automationstechnik.pl. Personal data collected by Automationstechnik Sp. z o.o. through the Website is processed in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), also known as GDPR. Automationstechnik Sp. z o.o. takes special care to respect the privacy of Users visiting the Website.
Who is the data controller?
The owner of the website and the data controller is Automationstechnik Sp. z o.o., with its registered office at ul. Rzemieślnicza 20A, 30-363 Kraków, registered in the register of entrepreneurs kept by the District Court for Kraków – Śródmieście in Kraków, 11th Commercial Division under number KRS 0000191568; REGON 003915177; NIP 6791168790 (hereinafter: the Company).
What types of data are processed, for what purposes, and on what legal basis?
Personal data of Users is collected in the following cases:
1. Contacting the Company by phone, email, or mail;
2. Sending inquiries using the contact form on the website to respond to inquiries in accordance with the legitimate interest of the data controller (Art. 6(1)(f) GDPR);
3. Sending commercial and marketing information electronically.
In the contact form, the User provides personal data such as name, company name, VAT number, city, company address, email address, and contact number. Providing data is always voluntary, but some of it is necessary to respond.
Sending commercial and marketing information electronically is based on the User’s prior consent. Such consent can be revoked at any time by sending a notification to biuro@automationstechnik.pl.
4. Sending personal data contained in the contact form and application documents in the “Career” section for the following purposes:
– Conducting the recruitment process for the position the Candidate is applying for. The processing of the Candidate’s personal data is based on labor law (Art. 6(1)(c) GDPR) and is necessary for pre-contractual measures (Art. 6(1)(b) GDPR), and for data not required by law, the processing is based on the Candidate’s consent (Art. 6(1)(a) GDPR).
– Conducting future recruitments if the Candidate has given consent for this purpose – the legal basis for processing will be the Candidate’s consent (Art. 6(1)(a) GDPR).
– Potential establishment, pursuit, or defense of claims – the legal basis for processing personal data will be our legitimate interest in establishing and pursuing claims or defending against claims (Art. 6(1)(f) GDPR).
In the contact form in the “Career” section, the user provides personal data such as name, email address, and contact number. Additionally, the candidate sends recruitment documents containing personal data.
Providing data is voluntary but necessary to participate in the recruitment. Additional personal data not listed in the legal provisions (e.g., image, interests) is processed based on the Candidate’s voluntary consent, which is expressed by sending their recruitment application to Automationstechnik Sp. z o.o., and providing it does not affect the possibility of participating in the recruitment.
Consent for personal data processing for recruitment purposes can be withdrawn at any time by sending a notification to biuro@automationstechnik.pl.
5. When using the Website, additional information may be collected, such as the User’s IP address or external IP address of the Internet provider, domain name, browser type, access time, and operating system type. The legal basis is the legitimate interest (Art. 6(1)(f) GDPR) to facilitate the use of electronic services and improve their functionality.
6. By selecting the newsletter subscription option, the user consents to receiving commercial information electronically for marketing purposes. The User’s personal data will be processed to send free newsletters containing information about the offer. Providing personal data is voluntary.
7. The collected data is analyzed using:
– Google Analytics provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, for creating statistics and analysis to optimize the website.
– Microsoft Clarity provided by Microsoft, 1 Microsoft Way, Redmond, WA 98052, USA, to analyze user behavior on the website for user experience analysis.
To whom are data disclosed or entrusted?
Personal data may be disclosed to authorized persons by Automationstechnik Sp. z o.o., entities providing services to the Company, including technical and organizational services, email services, and other entities/persons/bodies as required by law. In the event of the need to disclose personal data to third parties, Automationstechnik Sp. z o.o. requires confidentiality and security of information and their use solely for providing the specified service. The Company has appropriate data processing agreements with entities to which it discloses personal data.
How long are personal data stored?
1. Personal data of Candidates provided to Automationstechnik Sp. z o.o. for recruitment will be processed until the end of the recruitment for the specified position, and with the Candidate’s consent for future recruitments, for the period indicated in the consent clause.
2. Personal data of the User processed to handle inquiries will be processed by the Administrator during the correspondence period and then, depending on the results, will either be added to the customer/contractor database of the Company for contract implementation or deleted if there is no possibility of cooperation.
3. Personal data used to send commercial and marketing information electronically is sent until the User withdraws consent.
4. The Website Administrator will also store and use the User’s personal data if necessary for the establishment or defense of claims until the expiration of these claims.
Are data transferred outside the European Economic Area?
Personal data is not transferred to a third country/international organization.
Is automated personal data processing carried out?
Personal data is not processed in an automated way (including profiling).
Cookies
What are cookies?
Cookies are IT data, particularly text files, stored in the User’s end device and intended for using the Website. Cookies usually contain the website’s name, storage time on the end device, and a unique number.
What types of cookies does the Website use?
The Website uses two types of cookies:
1. Necessary cookies. Without these files, it is impossible to navigate the site or use its features. These are information stored in the browser’s memory until the browser session ends, i.e., until it is closed. Necessary cookies contribute to the site’s usability by enabling basic functions such as navigation and access to secure website areas. The website cannot function correctly without these cookies.
2. Optional cookies, i.e., statistical cookies that help understand how different users behave on the site by collecting and reporting anonymous information. Statistical cookies help website owners understand how visitors interact with websites by collecting and reporting information anonymously.
Basis for using cookies
Necessary cookies are processed based on Art. 6(1)(f) GDPR for purposes that constitute the legitimate interest of the administrator and users. The user can object to such processing of their personal data, but in practice, it will prevent or significantly hinder the use of the website www.automationstechnik.pl. Other cookies, i.e., statistical cookies, are processed based on the User’s consent in accordance with Art. 6(1)(a) GDPR.
Statistical cookies remain blocked until the User consents to using cookies. During the first visit to the website www.automationstechnik.pl, a message asking for the User’s consent to use these cookies is displayed.
How to manage cookies?
The User can manage cookie settings within their web browser. The User can block all or selected cookies. The User can also block cookies from specific websites. Previously saved cookies and other site data and plugins can also be deleted at any time.
Information on how to use this option can be found from the browser manufacturer (Opera, Firefox, Internet Explorer, Chrome, Safari). However, if the User decides to stay on the site without disabling cookies, they consent to their collection.
What are the Users’ rights?
1. Right to withdraw consent – legal basis: Art. 7(3) GDPR.
The user has the right to withdraw any consent given to Automationstechnik Sp. z o.o. at any time.
• Withdrawal of consent takes effect from the moment of withdrawal.
• Withdrawal of consent does not affect the processing carried out by the Company in accordance with the law before its withdrawal.
• Withdrawal of consent does not entail any negative consequences for the User but may prevent further use of services or functionalities that the Company may provide only with consent.
2. Right to object to data processing – legal basis: Art. 21 GDPR.
• The user has the right to object at any time – for reasons related to their particular situation – to the processing of their personal data, including profiling, if the Company processes their data based on a legitimate interest.
• If the User’s objection is justified and the Company has no other legal basis for processing personal data, the User’s personal data will be deleted against which the User objected.
3. Right to delete data (“right to be forgotten”) – legal basis: Art. 17 GDPR.
• The user has the right to request the deletion of all or some personal data.
• The user has the right to request the deletion of personal data if:
– personal data are no longer necessary for the purposes for which they were collected or otherwise processed;
– the consent on which the processing was based has been withdrawn, and there is no other legal basis for processing;
– an objection to the use of their data for marketing purposes has been raised;
– personal data are processed unlawfully;
– personal data must be deleted to fulfill a legal obligation stipulated in the law of the European Union or the Member State to which the Company is subject;
– personal data has been collected concerning the offering of information society services.
Despite the request to delete personal data, in connection with the opposition or withdrawal of consent, the Company may retain certain personal data to the extent necessary for establishing, pursuing, or defending claims.
4. Right to limit data processing – legal basis: Art. 18 GDPR.
The user has the right to request the restriction of their personal data processing. The submission of a request prevents the use of specific functionalities or services, the use of which will involve the processing of the data covered by the request. The user has the right to request the restriction of their data processing in the following cases:
• when they question the correctness of their personal data – then the Company restricts their use for the time needed to verify the correctness of the data, but not longer than 7 days;
• when the data processing is unlawful, and instead of deleting the data, the user requests the restriction of their use;
• when personal data is no longer necessary for the purposes for which they were collected or used, but they are needed by the user to establish, pursue, or defend claims;
• when they object to the use of their data – then the restriction occurs for the time needed to consider whether, due to the particular situation, the protection of the user’s interests, rights, and freedoms outweighs the interests pursued by the Company by processing the user’s personal data.
5. Right of access to data – legal basis: Art. 15 GDPR.
The user has the right to obtain from the Company confirmation whether their personal data is processed, and if so, the user has the right to:
• obtain access to their personal data;
• obtain information about the purposes of processing, categories of personal data processed, recipients or categories of recipients of this data, the planned period of storing the user’s data, or criteria for determining this period (when it is not possible to specify the planned period of data processing), the user’s rights under the GDPR and the right to lodge a complaint with a supervisory authority, the source of this data, automated decision-making, including profiling, and the security measures used in connection with the transfer of this data outside the European Union;
• obtain a copy of their personal data.
6. Right to rectify data – legal basis: Art. 16 GDPR.
The user has the right to request the rectification of their personal data from the Company that is incorrect. Taking into account the purposes of processing, the user has the right to request the completion of incomplete personal data, including by providing an additional statement, sending a request to the email address.
7. Right to data portability – legal basis: Art. 20 GDPR.
The user has the right to receive their personal data that they provided to the Company, and then send it to another personal data controller of their choice. The user also has the right to request that their personal data be sent by the Company directly to such an administrator, if technically possible. In such a case, the Company will send the user’s personal data in a commonly used, machine-readable format that allows the received data to be sent to another personal data controller.
In the event that a User exercises a right resulting from the aforementioned rights, the Administrator will fulfill the request or refuse to fulfill it immediately, but no later than within one month of receiving the request. However, if due to the complex nature of the request or the number of requests, the Administrator is unable to fulfill the request within one month, it will be fulfilled within the following two months, provided that the User is informed in advance, within one month of receiving the request, about the intended extension of the deadline and the reasons for it.
8. The User may submit complaints, inquiries, and requests to the Administrator regarding the processing of their personal data and the exercise of their rights.
9. The User has the right to lodge a complaint with the President of the Personal Data Protection Office regarding the violation of their personal data protection rights or other rights granted under the GDPR.
