Information Clause

Pursuant to Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons regarding the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (General Data Protection Regulation, “GDPR”), we inform you that:

1. The administrator of your personal data processed in connection with business relations, which may include sending offers, concluding and executing contracts, fulfilling orders, or conducting recruitment processes, is Automationstechnik Sp. z o.o., headquartered at Rzemieślnicza 20A, 30-363 Kraków, identified by NIP: 6791168790, registered in the Register of Entrepreneurs kept by the District Court for Kraków-Śródmieście in Kraków, XI Commercial Division, under KRS number 0000191568; REGON 003915177 (hereinafter referred to as “ADO”).

3. If you have not provided your personal data directly to ADO, your data has been obtained from an entity on whose behalf you act or from an entity that provided your personal data to ADO as necessary for the conclusion and execution of a contract with that entity or for business-related purposes. Additionally, your personal data may be obtained from publicly available sources such as databases and registers, including CEIDG, KRS, websites, LinkedIn, Facebook, and Instagram.

4. The legal basis for processing personal data includes:
a. Your consent, including for receiving offers and marketing information or processing candidate data for recruitment processes (Article 6(1)(a) GDPR),
b. Performance of a contract or taking pre-contractual actions at your request (Article 6(1)(b) GDPR),
c. Compliance with a legal obligation imposed on ADO by specific regulations (Article 6(1)(c) GDPR),
d. Legitimate interests of ADO, such as maintaining business relations or establishing, pursuing, or defending legal claims (Article 6(1)(f) GDPR).

5. Your personal data is processed depending on the content of the received correspondence, for purposes such as:
a. Responding to your inquiries and handling ongoing correspondence,
b. Considering the matter you have raised,
c. Concluding and executing a contract,
d. Conducting recruitment processes.

Personal data may also be used for direct marketing purposes (with separate consent) or for pursuing or defending against claims, based on ADO’s legitimate interests.

6. The following categories of personal data are processed:
a. Basic identification data, such as name and surname,
b. Contact details, including phone number, business address, and email address,
c. Identification numbers, necessary for precise identification,
d. Job position and company details,
e. Other data necessary for recruitment purposes.

7. Personal data is stored for the necessary period to maintain correspondence on a given topic, and afterward, for the time required by legal obligations imposed on ADO.

8. Personal data processed for contract execution will be stored for the duration of the contract and after its termination for a period required by law, not exceeding six years from the end of cooperation. After contract expiration, processing will be limited to archival, tax, and legal claim purposes.

9. Personal data used for recruitment purposes will be stored for the duration of the recruitment process and for six months afterward for potential claims. If consent is given for future recruitments, data may be stored for up to 12 months.

10. Personal data may be disclosed to:

Authorized personnel of ADO,

Business partners of ADO,

Entities providing services to ADO, including technical, organizational, and email hosting services,

Other entities/persons/authorities in accordance with applicable laws.

11. Personal data may be transferred to the United States or any other country where Microsoft operates, as ADO uses Microsoft’s systems and applications. Microsoft guarantees compliance with GDPR for data collected, used, transferred, stored, and otherwise processed in EEA and Switzerland.

12. You have the right to:

Request access to your personal data and rectification of inaccurate data.

13. If your data is processed based on your consent, you may withdraw it at any time by sending an email to biuro@automationstechnik.pl. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

14. Under specific legal conditions, you have the right to:

  • Request erasure of your data,
  • Request restriction of processing,
  • Request data portability,
  • Object to processing of your data.

15. If you believe ADO has violated data protection regulations, you have the right to lodge a complaint with the data protection authority.

16. Your personal data will not be used for automated decision-making, including profiling.

17. Since your personal data is processed for ADO’s legitimate interests, you have the right to object to such processing for reasons related to your particular situation.
